These Terms of Service (the "Terms") govern your access to and use of the ZEROPUNK website (the "Site"), operated by the ZEROPUNK Project ("we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Acceptance of the Terms
By visiting, browsing, registering for our newsletter, contacting us, or otherwise interacting with the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. These Terms apply to all visitors, users, and others who access the Site.
2. Eligibility
The Site is intended for users aged 16 or older. If you are under the age of 16, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Site, you represent and warrant that you meet these eligibility requirements.
3. Project Status
ZEROPUNK is an independent video game project currently in active development. All content presented on the Site — including descriptions, screenshots, videos, characters, lore, features and roadmaps — is provided for informational purposes only and may evolve, change, or be removed at any time without notice. Nothing on the Site constitutes a commercial offer, a release commitment, or a promise of any specific feature in the final product.
4. Intellectual Property
All content available on the Site — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, characters, names, story elements, source code, software, and the overall "look and feel" — is the exclusive property of the ZEROPUNK Project or its licensors and is protected by French and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site for personal, non-commercial purposes. Any reproduction, representation, modification, distribution, public communication, exploitation or creation of derivative works based on all or part of the Site, by any means and on any medium, without our prior written authorization, is strictly forbidden and constitutes an act of counterfeiting punishable by Articles L.335-2 and following of the French Intellectual Property Code.
5. Acceptable Use
You agree not to: (a) use the Site in any way that violates any applicable law or regulation; (b) attempt to gain unauthorized access to the Site, its servers, or any connected systems; (c) use any automated system (bots, scrapers, crawlers) to access the Site in a manner that sends more requests than a human can reasonably produce; (d) introduce viruses, trojans, worms, logic bombs or other malicious material; (e) impersonate or attempt to impersonate the ZEROPUNK Project, an employee, another user, or any other person; (f) engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which may harm the ZEROPUNK Project or users of the Site.
6. User-Submitted Content
If you send us messages, feedback, or suggestions through the contact form, our email address, or our community channels, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, adapt and incorporate such content into the project, without any compensation. You represent that any content you submit is your own and does not infringe the rights of any third party.
7. Donations and Voluntary Support
Donations made via Buy Me a Coffee or any other support platform are voluntary contributions to the ZEROPUNK Project. Donations are non-refundable except where required by applicable law. Any perks announced (such as Discord roles or early-access content) are offered as a token of appreciation and are not contractual obligations; we reserve the right to modify or remove perks at any time.
8. Third-Party Links and Services
The Site may contain links to third-party websites or services (including Discord, YouTube, Twitter/X, TikTok, Instagram, Buy Me a Coffee). We do not own or control these third parties, and we are not responsible for their content, privacy practices, or terms. Your use of any third-party service is at your own risk and subject to that third party's own terms and policies.
9. Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by applicable law, the ZEROPUNK Project shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to, use of, or inability to use the Site; (b) any conduct or content of any third party on the Site; or (c) unauthorized access, use, or alteration of your transmissions or content.
11. Modifications to the Site and the Terms
We reserve the right to modify, suspend, or discontinue all or part of the Site at any time, with or without notice. We may also revise these Terms at any time. The updated version will be indicated by the "Last updated" date at the top of this page. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.
12. Termination
We may, in our sole discretion and without prior notice, restrict, suspend, or terminate your access to all or part of the Site, in particular in case of violation of these Terms, without any compensation to you.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or your use of the Site shall be submitted to the exclusive jurisdiction of the competent French courts, subject to mandatory consumer protection rules applicable to your country of residence.
